File No. M-2002-052 <br />Two Rivers 112 Permit Amendment Application- Adequacy Review <br />Dear Mr. Condon, <br />Listed below are adequacy review comments for the Two Rivers Pit 112 Permit Amendment Application, File <br />No. M-2002-052. The Division of Minerals and Geology ("Division") is required to make an approval or denial <br />decision no later than July 19, 2002, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />Rule 6.4.3 Exhibit C-Pre-minine and Minine Plan Map(s) of Affected Lands <br />2. Exhibit C is defined as the Pre-mining and Mining Plan Map(s) of Affected Lands. a.) The maps do not <br />indicate the owner of land to the east of the proposed permit site. Please indicate owner(s) of land to the east <br />of the proposed site. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />Exhibit E is defined at the Reclamation Plan. The Reclamation Plan submitted with the permit application <br />indicates that the post-mined land use will include awater-storage reservoir. The plan further indicates that <br />the slopes of the water reservoir will be graded to 3H:1V "both above and slightly below the expected high <br />water-line, for the filled reservoir." The applicant should be aware that 3.1.5 (7) of the Construction Material <br />Rules and Regulations requires that the slopes be not greater than 3:1 from 5 fee[ vertically above and 10 feet <br />vertically below the expected water line. If the water in the reservoir is intended as a water source from <br />which water will be removed periodically, the fluctuation in the water level must be considered in the final <br />grading of the slopes, and the slopes shall not be more than 3:1 to 10 feet vertically below the expected low <br />water level. Please commit to slopes of no greater than 3:1 to 10 feet vertically below the expected low water <br />level. <br />
