Rule 6.4.7 Exhibit G- Water Information <br />4. Exhibit G is defined as Water Information. The applicant indicates that a Temporary Substitute Supply Plan <br />will be submitted as part of the application once Applegate Group had completed the plan. The application <br />indicates that some information required to make the permit application complete, including wells within 600 <br />feet of the permit area and consumptive use of water at the operation, is contained in this plan. Therefore, the <br />plan must be submitted to the DIVISION and reviewed prior to approval of the permit. Please supply the <br />Temporary Substitute Supply Plan prior to the deadline date, allowing enough time before the deadline for <br />review of the plan. <br />5. The applicant should be aware that 3.1.6 (1) of the Constmction Material Rules and Regulations requires that <br />disturbances to the prevailing hydrologic balance of the affected land and to the surrounding area and to the <br />quantity and quality of water in surface and groundwater systems both during and after the mining operation <br />and during reclamation shall be minimized. The permit application does not indicate what measures will be <br />taken to assure that the operation is not affecting the hydrologic balance in the area. In that the proposed <br />operation includes dewatering of the pit and installation of a liner in the mined-out pit, the potential for <br />impacts to groundwater exists. Please indicate how the hydrologic balance of groundwater in and around the <br />permit site will be monitored. <br />6. (2)(b) The known aquifers are not identified. Please identify all known aquifers which occur below the site. <br />7. (5) The applicant has not indicated that the operator/applicant has acquired (or has applied for) a National <br />Pollution Discharge Elimination System (NPDES) permit. Please submit proof of application for the above <br />permit. <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />8. Exhibit L is defined as Reclamation Costs. The estimated reclamation costs that form the basis of the required <br />bond for the Perry Pit will be evaluated and an estimate by the DIVISION will be forwarded to the applicant <br />in a separate letter prior to the decision deadline. <br />Rule 6.4.16 Exhibit P - Municikalities Within Two Miles <br />9. Exhibit P is defined as Municipalities Within Two Miles. The application indicates that the town of Milliken <br />is located within two miles of the site, but does not include the address of the general offices for Milliken. <br />Please supply the address for the general offices of the town of Milliken. <br />Rule 6.4.19 Exhibit S -Permanent Man-Made Structures <br />10. Exhibit S is defined as Permanent Man-Made Structures. Where the mining operation will adversely affect <br />the stability of any significant, valuable or permanent man-made structure located within two hundred feet of <br />affected land, the applicant may either provide a notarized compensatory agreement between the <br />Applicant/Operator and the owner of the structures, or provide an engineering evaluation indicating that <br />mining activities at the site will not adversely affect the structures. The application indicates that the water <br />and sewer lines which run within the UPRR right-of--way are at least 100 feet from the proposed mining <br />activity. If these lines aze within 200 feet of [he permit area, please commit to submitting an agreement or <br />engineering evaluation as described above prior to any activity within 200 feet of these structures. <br />11. The Mine Plan map identifies fences which are located within 200 feet of the proposed mining operation. <br />Please indicate ownership of these fences, if not owned by the operator, and if not owned by the operator, <br />commit to submittal of similar agreements or reports as described above relating to the fences. <br />
