Long <br />Division Director <br />RE: Status and Progreso Report, Battle Mountain Gold, Hoa d Ordered <br />Abatement Plan, San Luis Project, April 23, 1992 Noti a of <br />Violation No. M-92-26, File No. M-88-112 <br />At a Formal Public Hearing held before the Mined Land Reclamation Board on <br />April 23, 1992, Battle Mountain Resources, Inc. (BMRI) was found o be in <br />violation of C.R.S. 34-32-134 (1984 and 1991 supp.) for failure t comply with <br />the terms and conditions of its permit. The Board assessed a civ'1 penalty in <br />the amount of $168,900.00 and ordered 12 violation abatement requirements. The <br />civil penalty was assessed for violations that occurred during th period <br />October 16, 1991 through April 7, 1992. The Board also decided t at "if the <br />cyanide continues to exceed the levels allowed under the permit o or after <br />April 8, 1992, such levels may constitute a separate violation of the permit." <br />This issue will be revisited by the Division before the Board at later date. <br />The status of the 12 abatement requirements and BMRI's progress o~ each is <br />discussed below. This report covers the period February 24, 1993 through <br />June 22, 1993. / ~r (~~ / <br />r/1. Increased Tailin4s Area Security: <br />Status: Completed. <br />Prooress: BMG completed all Board ordered tailings area s curity. The <br />Division has set process water cyanide standards, (see Feb ary 24, 1993 <br />report) that if not met will trigger automatic resumption o the security <br />as originally ordered by the Board. <br />/2. Assessment of Environmental Impact: <br />Status: Completed. <br />Prooress: BMG submitted an acceptable report April 13, 192. <br />/3. Accelerated Frequency of Environmental Monitoring: <br />Status: In Compliance. <br />Prooress: BMG is now monitoring and reporting in accordan a with <br />approved technical revisions nos. 6 and 10. The Division r views each <br />report as it is received. No significant problems have bee noted. <br />
