MCC has also <br />requested an exception to the controlled surface use and timing stipulations for big game winter <br />range attached to federal coal lease C-1362. Stipulations on federal coal lease C-1362 call for <br />limited surface use from December 1 to April 30 to protect big game on the winter range. <br />MCC has requested these authorizations to access the thermal event drilling locations to continue <br />monitoring gas and water levels in the underground workings as required by the Mining Safety <br />and Heal[h Administration (MSHA). MCC personnel have indicated that using these Forest <br />Service roads would provide the safest means for ingress and egress of personnel working at the <br />thermal event drilling location. <br />By this letter, MCC has been authorized by the District Ranger to use and plow snow on FR 711 <br />and FR 711.2B under the terms presented in MCCs current road use permit (RUP). All snow <br />removal must comply with the requirements given in Clause lE of the RUP. It is MCCs <br />responsibility to ensure that the snow removal contractor is aware of, and complies with these <br />requirements. <br />Understanding that MSHA has required MCC to continue monitoring the conditions <br />underground through the boreholes installed on the land surface, the Forest Service hereby grants <br />MCC an exception to the controlled surface use and timing stipulations for big game winter <br />range on C-1362 for this 2000-2001 winter season. <br />These authorizations aze given under the following conditions: <br />1. Other forest users will be allowed on FR 711 to the junction of FR 711.2B, and on FR <br />711.2B to the administrative closure in place on FR 711.2B. The closure gate on FR 711 (a1 <br />the corrals) will remain open, and will only be closed at the direction of the Forest Service. <br />We would like to remind MCC that the administrative closure on the Apache Rocks road at <br />Sylvester Gulch allows for public access on conveyances other than full-sized vehicles. <br />Caring for the Land and Serving People PnnleO an RecycleE Paperi~ <br />
