Sims Gravel Company and all other persons engaged in or owning or <br />controlling the following operation: East Douglas Pit, File No. M-87-103 <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findtr~gs of fact: <br />1. M. Sims Gravel Company is permitted to conduct a mining operation under <br />the terms of Permit M-87-103 located in Rio Blanco County, Section 35, <br />Township 2 South, Range 101 West of the 6th P.M., in Rio Blanco County, <br />Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on <br />February 26, 1992 to consider possible violation of the terms of Permit <br />M-87-103 and C.R.S. 34-32-101 et sea. <br />3. Th.a Mined Land Reclamation Division presented evidence at the formal <br />Public Hearing on February 26, 1992, demonstrating that: <br />C1) Mining and stockpiling has occurred outside the permit houndary. <br />
