<br />-2- <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />M. Sims Gravel Company to be in violation of Permit M-87-103 and <br />C.R.S. 34-32-123(2). <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders M. Sims Gravel Company to: <br />1. Cease and desist from conducting the following mining operations at the <br />East Douglas Pit Site - Permit M-87-103: continued excavation or stockpiling <br />rock ai; the site until an approved amendment is obtained which includes the <br />additional area of disturbance. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Cortiplete the following corrective action: <br />- Amend the current mining and reclamation plans to include the <br />additional disturbed area by March 25, 1992. <br />4. The Colorado Mined Land Reclamation Board decided to hold consideration <br />of a civil penaity in abeyance until the March Board meeting. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />
