Mount <br />Reclamation Specialist <br />Colorado Mined Land Reclamation Division <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />III IIIllllllllllll! <br />5731 State Highway 13 <br />Meeker, Colorado 81641 <br />(303) 824-4451 <br />Re: Preliminary Adequacy Review, Permit Revision <br />No. 1 and Permit Renewal No. 2,~Colowyo <br />Mine, Permit C-81-019 <br />Dear Mr. Mount: <br />The purpose of this letter is to respond to the Division's <br />correspondence of July 18, 1991, addressing the following 3 issues. <br />Rule 2.03.4 <br />The updated pages for this section are attached. <br />BLM Lands - Right of Entry <br />Colowyo initiated contact with the BLM Little Snake Resource <br />Area office in Craig on May 24, 1991, regarding the procedures for <br />obtaining the right of entry on BLM lands in Section 21, Township <br />3 North, Range 93 West. We have since had additional contact with <br />the BLM on a number of occasions and have received no indication of <br />conflicts which would prohibit issuance of right-of-ways or leases <br />on these lands by the BLM. Negotiations are currently ongoing. <br />Right of entry for the effected portions of Sections 14 and 15 <br />are not necessary as Colowyo owns the surface to be disturbed. The <br />mining and reclamation plan for the C-29224 coal lease (held by <br />Colowyo) located within these sections will also be approved during <br />the normal permit review process. <br />Since these issues are actively being pursued by Colowyo and <br />the BLM, we see no reason to delay the permit review process. <br />Also, the BLM surface in question is minor and may not be disturbed <br />for a number of years, but the BLM's permitting process could take <br />a couple of months. Such a delay in the review of the Colowyo MLRD <br />permit waiting for BLM approvals, would be of limited value and <br />would needlessly delay issuance of the permit. <br />
