Specific <br />information apparently not on file at the mine office includes quarterly refuse inspections, an <br />updated sediment pond certification, a current certificate of public liability insurance, and a haul <br />road certification. <br />The steps necessary to abate the violation are the following: Ensure current engineering <br />certification for the sediment pond, refuse pile and haul roads, and a current certificate of insurance <br />are submitted to the Division and placed on file at the mine office. An alternative to submittal of haul <br />road certification can be submittal of a revision to re-classify the haul road. <br />EFMC has responded with current certification of the refuse pile and certificate of insurance. <br />In addition, EFMC submitted and received approval of Technical Revision No. 10 to re-classify haul <br />roads to access roads. <br />In response to pond certification, EFMC submitted Technical Revision No. 12, after <br />determining that the existing pond required expansion. The revision was submitted June 30, 1993, <br />and approved. by the Division. Approval date, including public comment period, was on or about <br />October 30, 1993. I <br />EFMC completed and mailed bid request letters to five contractors on October 29, 1993. Bid <br />responses were received and evaluated over the next two-week period, and the successful bidder <br />was notified to start work as soon as possible. During this time EFMC requestedand received <br />approval of an abatement extension to December 23, 1993, based on our knowledge of the <br />contractor's expected time to complete the pond expansion work. <br /> <br />
