Long <br />Re: Foidel Creek Mine, C-82-056, Permit Revision No. ~ D.msum Drtpuor <br />Dear Mr. Mills: <br />The Division has reviewed in accordance with Rule 2.08.4, Twentymile Coal Company's application for a <br />permit revision, PR-O5, to allow for mining in the Northern Mining District. The following questions are <br />a result of the Division's review. <br />Vegetation Information; Rule 2.04.10 <br />~1. Revised page 2.04-61 (rev. 2/24/99) indicated that since there would be no new surface disturbance to <br />the lands overlying the NoRhem Mining District, there would be no impacts to rare or endangered <br />plant species. Potential impacts include subsidence to the alluvial valley floor of Fish Creek. Please <br />provide information to the Division demonstrating that Twentymile Coal Company has evaluated <br />impacts to rare and endangered plant species in accordance with Rules 2.04.10(5) and 2.05.6(2)(a)(iii) <br />with regazd to subsidence of the Fish Creek alluvial valley floor. If this demonstration has been made <br />elsewhere in the application, please specify where this information may be found. <br />2 In Twentymile Coal Company's discussion of impacts to fish and wildlife, found on revised page <br />2.04-80.1 (rev. 2/2/98), Twentymile Coal Company identifies this page as having been revised during <br />PR-04, with a revised date of 2/2/98. The context of this page submitted with PR-OS is different than <br />the page approved during PR-04. Twentymile Coal Company's identifier should reflect that the page <br />was submitted with PR-OS and reflect a revised date that corresponds to the PR-0~ permitting action. <br />This same page contains discussion of the Ute Ladies Tresses orchid. Since this section of the <br />permit, section 2.04.11, pertains to Fish and Wildlife, discussion of raze and endangered plant species <br />would be better presented in the vegetation section, 2.04.10. Please correct and resubmit this page. <br />Formatting <br />3. Revised page 2.05-2 (re. 8/27/99) does not include information found on approved page 2.0>-2 (rev. <br />8/26/99 TR 99-33) regazding the 1000 foot longwall face panels. Please retain the information <br />previously approved on this page in addition to the proposed PR-OS changes. <br />4.
