MANACEM14'M <br />The DMG's letter dated August 31, 1999 was an order to revise portions of Powderhorn Coal Company's <br />(PCC) permit as a result of the OSM/DMG special focus "land disturbance" inspection. On behalf of PCC, <br />following aze its responses to the DMG's categories of wncem: <br />Concern No. 1 -Haul road segments inappropriately desi ed as public roads <br />The section of public road in question extends from the west where Haul Road Nos. 4 & 5 intersect to the east <br />to an uncertain location. I talked to Mesa County (Keith Cory 244-1876) regarding their ownership and <br />maintenance of the county (public) road. Mr. Cory indicated the county claims ownership of the entire reach <br />of road through the private property up to BLM land. This would include all of Haul Road No. 4. The wooly <br />only ma~rrtainc the road up to the east side of the I-Tighline Canal. Public Service Company employees, vendors <br />etc. utilize the wanly road up to the east side of the canal. PCC has historically maintained the pubfic road <br />from the Highline Canal to the west. Based on the foregoing information, the wanly (public) road from the <br />east side of the Higliline Canal to the west will be a designated Haul Road No. 5. Exhibit (Map) series 8 and <br />9 were revised to indicate Haul Road No. 5 begins on the east side of the Highline Canal and extends to CRDA <br />No. 1. The description of Haul Road No. 5 was also revised in Table 13-2 page T13-2~. <br />Haul Road No. 2 forks off of the public road to the right a short distance from the canal crossing. Tbis <br />segment extends approximately 400-feet to the permit boundary at the road crossing of Coal Creek. Even <br />though this 400-foot long haul road segment was outside of the permit boundary, it is described in Table 13-2 <br />as if it were within the penny boundary. The description of Haul Road No. 2 was revised in Table 13-2 page <br />T 13-2-1 to indicate it extends from Haul Road No. 5 instead of the wanly road. <br />Concern No. 2 -Disturbances located outside designated disturbed areas <br />The following disturbances were noted to extend beyond the "surface affected area" depicted on the permit <br />maps: <br />
