Peter Matthies <br />NCIG Financial, Inc. <br />7476 East Arkansas Avenue, tt104 <br />Denver, CO 80231 <br />RE: Technical Revision Nos. 8 & 9;,Coa1 Ridge Mine (C-85-065) <br />s, <br />Dear Mr. Matthies: <br />This letter is in response to your letter to the Division dated October 4, <br />1991, and is intended to clarify the confusion regarding public copies of the <br />above referenced revisions at the Garfield County Clerk and Recorder's <br />Office. Tom Gillis, of our office, reviewed the NCIG documentation on file in - <br />Garfield County on October 29, 1991. A copy of his memo summarizing his <br />findings is enclosed. <br />The Division also received a letter from Mr. Greg McKennis, of the Garfield <br />Citizens' Alliance, dated October 19, 1991, expressing concern about public <br />copies of TR-08 at the County Courthouse. A copy of this letter is enclosed <br />also. A copy of an earlier letter from Mr. McKennis regarding TR-09 was <br />forwarded to you at an earlier date. <br />Based upon the Division's review of this situation, conversations with the <br />Garfield County Clerk and yourself, and Mr. McKennis' comments, the Division <br />finds that a complete copy of applications for TR-08 and TR-09 has not been <br />available for public inspection, as required by Rule 2.08.4(5)(b)(i) of our <br />Regulations. Most of the required pages and exhibits are in the Courthouse at <br />this time. However, it is not clear that they have been there since the <br />public notice publications on September 5 and 11, 1991. Furthermore, these <br />pages have been inserted into the permit application package, and the <br />currently approved pages are no longer available at the Courthouse. <br />The Division is aware that NCIG made an effort to provide the required public <br />files. However, in light of the circumstances above, it is clear that the <br />intent of the Regulations has not been met. In order to assure interested <br />citizens an opportunity to review the revision applications, the Division <br />requires that NCIG republish public notice for the two revisions and place <br />new, complete copies of the revision applications on file with the Garfield <br />County Clerk and Recorder's Office. <br />
