Peter Matthies -2- November 4, 1991 <br />The following procedure should be followed for TR-O9 and TR-09 public notice <br />at this time: <br />Public notice should be republished once in the Glenwood Post. One <br />notice mentioning both revisions will be adequate. The notice <br />should include a summary of the substance of the revisions (i.e., <br />coal mine waste design and adequacy issues associated with permit <br />renewal). <br />2. Complete copies of each application should be placed in the <br />Garfield County Clerk and Recorder's Office. These materials <br />should remain as separate documents and not be inserted into the <br />permit application package until a final decision has been made by <br />the Division to approve the revisions. <br />3. Copies of the materials removed from the currently approved permit <br />application package need to be replaced at the Clerk's Office. <br />These materials should remain in the currently approved permit <br />application package until revised pages have been approved by the <br />Division. <br />4. Steps 1 through 3 should also be done at the Glenwood Springs BLM <br />Office, unless reference to this office is deleted from the public <br />notice. <br />In order to avoid similar confusion in the future, the Division suggests that <br />all materials submitted as public copies be accompanied by a cover letter <br />listing the contents. This letter could be stamped with a received date by <br />the Clerk's Office or sent certified mail. NCIG may also want to reconsider <br />whether it wishes to place materials in the BLM Office in Glenwood Springs. <br />One copy of public material at the Courthouse meets the requirements of our <br />Regulations. <br />Hopefully, following the process above ~.aill clarify the confusion regarding <br />public files for these and future revisions to the Coal Ridge permit. The <br />Division has completed its review of responses to adequacy questions for TR-09 <br />and is preparing a preliminary adequacy review letter for TR-08 which you <br />should receive soon. The Division is also preparing to publish a proposed <br />decision to approve TR-07 at this time. <br />A copy of the Notice of Intent to Explore application is also enclosed, as you <br />requested.
