Colorado 80203 <br />Re: Colowyo Coal Mine (C-81-019) <br />RN-3 Application <br />Comments Regarding the August 18, <br />Permit Renewal Application No. 3 <br />Dear Mr. Walker: <br />~% III IIIIIIIIIIIIIIII <br />~ ~ -----= a~ , <br />Coloafyo Cool ConrpanyL.P. `:; <br />1997 Division Proposed Decision to Approve, <br />The following information is provided as comments regarding the August 18, 1997 Division <br />Proposed Decision to Approve and Findings of Compliance for the Colowyo Coal Mine, C-81-019, <br />Permit Renewal No. 3. <br />Colowyo appreciates the Division's continued diligence in processing the RN-3 Application <br />and is pleased to offer the following suggestions or minor corrections regarding the Findings <br />Document. <br />1) Page 24 -Paragraph 5. The Division notes that one sediment control pond is located <br />within 100 feet of a public road right-of-way. As a matter of fact two ponds (Streeter and <br />Prospect) are located near the Colorado State Highway 13 right-of way. <br />2) Page 25 -Paragraph 3 ("D"). Regarding the AVS system, the reference to Colowyo <br />should include an "L.P." after Colowyo Coal Company. <br />3) Page 32 -first paragraph, last sentence. We believe that "Depth to Water (dissolved <br />metals)" is a typo and suggest it be reviewed and corrected. <br />4) Page 34 -first paragraph. We believe the standard criteria for pond discharges (CDPS <br />Permit, State Engineer's office, etc.) is 48 hours rather than 36 hours. <br />5) Page 35 -first paragraph, last sentence. The reference to "564 acres of disturbed lands <br />have been backfilled and graded, and 550 acres reseeded" should clarify that this acreage was <br />reclaimed during the previous 5 year permit term. A casual observer may read the current <br />paragraph and conclude that Colowyo has only a total of 564 acres of disturbed lands backfilled <br />and graded and 550 acres reseeded. <br />6) Page 42 -second paragraph, second sentence. To be consistent with the Permit we <br />believe the sentence regarding scarifying of regraded spoils should clarify that scarifying is <br />completed "where necessary." <br />
