Banta. <br />Division Direcmr <br />I have reviewed the above-referenced letter, in which Mr. Jim Stover requests <br />that we allow the removal of the sediment pond at the Red Canyon Mine. The <br />request is based upon our Rule 4.05.7_(2). It is ~ opinion that the operator <br />has not Drovided adequate information to allow removal of the sediment pond. <br />The following information is required before we can approve pond removal <br />pursuant to Rule 4.05.2(2). <br />The request must he submitted in the form of a technical revision. <br />2. A demonstration that the disturbed area draining to the pond is <br />revegetated and stabilized. This revegetation requirement seems to <br />be satisfied, according to Carl's memorandum dated December 13, <br />1990. <br />The stabilization requirement should be„specifically, and <br />separately addressed. This may be done by having one of of.':- <br />inspectors, familiar with the site, Drovide an assessment. <br />However, the operator should probably provide some type of erosion <br />survey which will address rill and gully development at the site. <br />3. A demonstration must be Drovided which clearly shows that the <br />untreated drainage from the disturbed area has ceased to contribute <br />additional suspended solids above natural conditions. This <br />demonstration is an absolute requirement; however, no such <br />demonstration is provided. <br />The requirement can be met by sampling pond inflow for total <br />suspended solids, for comparison with suspended solids data for <br />some similar natural drainage. We can also consider a model <br />approach if actual sampling is impossible. The operator must <br />develop a plan to make this demonstration. <br />STATE OF COLORADO <br />
