The applicant must also demonstrate that the quality of untreated <br />drainage from the disturbed area meets the state and federal water <br />quality standard requirements applicable after the sedimentation <br />ponds and treatment facilities are removed, if any, for receiving <br />streams. This means that the operation must show that the <br />disturbed area drainage will not jeopardize any local receiving <br />steam quality standards. This should also be done by developing a <br />pond inflow sampling program. No such demonstration has yet been <br />provided. <br />5. If the pond receives any discharge from an underground mine, the <br />pond must remain in place until the discharge from the mine <br />continuously meets effluent limitations without treatment, or until <br />the discharge ceases. I do not know if the pond receives such <br />drainage. <br />Please feel free to request more assistance, as you receive additional <br />submittals or questions from the operator. <br />DAB/yjb <br />3551E <br /> <br />
