Dear Mr. Thompson:
On Febrtuuy 14, 2007 the Mined Land Reclamation Board approved the Amendment application submitted to the
Division on September 15, 2006, addressing the following:
Extension of mining to the east with addition of 19..69 acres jor a total permitted acreage of 69.62 acres.
The terms of the Amendment No. 2 approved by the Board were incorporated into Permit No. M-1983-102.
The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-1983-102
remain in full force and effect.
Stipulation No. Description
No dust suppression chemicals will be used on site.
By no later than April 13, 2007, the operator will submit and complete an approvable monitoring plan for
Division consideration that will include no less than three monitoring wells placed to protect adjacent well
owners. Such monitoring plan will be submitted as a technical revision with copies to all objectors to the
amendment application. The data will be collected and submitted quarterly to the Division.
The revised estimated liability amount of $111,500.00 surety requirement exceeds the $34,640.00 surety performance
bond currently held. If you have not already done so, please submit additional bond in the amount of $76,860.00. The
revision will not be final until the bond is approved by the Division. A copy of the bond estimate is enclosed.
