Applegate
Group, ~~~.
May 31, 2007 ,
Mr. Thomas Schreiner
Environmental Protection Specialist
Division of Reclamation, Mining, and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: ~~Acreage Release Request; Jake Kauffman & Son, Inc.;
Wagner/Kauffman Pit #3; M-99-069 L/!{JSS; j~zv/S~`o~~
pe S~, ~9f2 a.
Dear Mr. Schreiner:
RECEIVED
[JUN U 8 2007
pNision o5 ReCBa eH n,
Mintn9 and
- ~~
No ~ ~ ~~
The following information is being submitted on behalf of our client, Jake Kauffrnari 8c Son, Inc.
The Wagner/Kauffinan Pit #3 mining operation (N1-99-069) is located mainly in the Northwest'/.
of the Northwest'/a of Section 21, Township 5 North, Range 68 West of the 6`" P.IvI. The site is
located in Larimer County approximately 1.5 miles east of Loveland, Colorado.
Phase I of the mining operation covers the east half of the permit azea, with approximately 66
total acres being mined. Mining in Phase I is essentially complete. Reclamation activities have
been concurrent with mining and approximately 47 acres of Phase I have previously been
released by the State in a letter dated July 27, 2005. An additional 5.3 acres have been backfilled
and revegetated consistent with Exhibit E, Reclamation Plan, of the Reclamation Permit
Application.
Similar to the release you assisted us with a few years ago. Jake Kauffman & Son, Inc. is
requesting release of an additional 5.3 acres of the permit area for the reclamation activities
completed. A reduction in the permit fmancial warranty is NOT being requested. The affected
azea has been backfilled, graded, and revegetated consistent with Exhibit E bf the Reclamation
Permit Application. All backfilling and grading activities on the 5.3-acre portion of the site were
done as mining progressed. Final grading was finished in the summer of 2005 after mining
operations were completed and revegetation of the site was performed in Fa112005. The attached
revised Reclamation Plan Map illustrates the additional acreage requested-for release. The owner
seeded the affected azea with pasture grasses consistent with the final land use, and the vegetative
cover is presently doing well. The azea is being watered with a sprinkler system.
In compliance with Subsections 3.1.1 through 3.1.4 of Section 3.1, Reclamation Performance
Standards, Construction Material Rules and Regulations, apost-mining land use was established
1499 West 120th Avenue, Suite 200 - - ~ (303) 452-6611 • Fax (303) 452-2759
Denver, Colorado 80234-2759 ~ ~ ' www.applegategroup.com
