Box 191 Division Dkeaor <br />Victor, CO 80860 <br />RE: Cresson Mine (Permit M-80-244) Required submittal of Technical <br />Revision proposing numeric protection levels and Points of <br />Compliance for groundwater <br />Dear Mr. Hardaway: <br />On May 14, 1997, following a brief physical inspection of the Phase <br />2 area of the mine, the Division discussed with you the Division's <br />May 1, 1997 letter requiring CC&V submit a Technical Revision with <br />proposed groundwater permit conditions and Points of Compliance by <br />August 1, 1997 (as per pre-enforcement procedures described under <br />Rule 3.1.7 (3) (a) (ii)). During the course of that discussion, you <br />informed the Division that you had proposed a classification of the <br />groundwater in Arequa Gulch to the Water Quality Control Commission <br />(WQCC) and that matter was to be heard during the Commission's <br />September 1997 meeting. Rather than pursue with CC&V the setting of <br />numeric protection levels and Points of Compliance for the <br />currently unclassified groundwater in that drainage, it was then <br />indicated to you by the Division that, so far as groundwater in <br />Arequa Gulch was concerned, CC&V need only provide the Division the <br />proposal made to the WQCC. The Technical Revision, however, <br />containing numeric protection levels and Points of Compliance for <br />other areas where the Cresson Mine has the potential to adversely <br />impact groundwater quality indicated to be suitable for beneficial <br />use, eg. in the Wilson Gulch/Bateman Creek area, would still be <br />required by August 1, 1997. <br />During the same May 14, 1997 meeting, you requested and the <br />Division committed to provide you with a description of the <br />groundwater data from the mine currently available to the Division <br />as well as some additional information regarding the nature of the <br />Division's groundwater concerns in the area of the mine in order <br />that your forthcoming proposals be better focused. <br />As for the groundwater data so far made available by the mine to <br />the Division, CC&V has provided a listing of analytical data, dates <br />and depths for samples taken in the Arequa Gulch and Wilson <br />
