In the correspondence received by the applicant from Colorado <br />Department of Health (CDOH), Air Pollution Control Division <br />(of which we have a copy), regarding an air pollution emission <br />permit, an annual production rate of 70,000 tons or less was <br />cited. Is this in fact what the production will be? I found <br />no other references to it in the application. <br />2. Exhibit C contains a set of maps which need some corrections <br />or additional features. The Pre-mining Map (and the others <br />too) should have the location of the overhead powerlines moved <br />to the north side of the road, within the fence in Section 8. <br />The applicant must also supply statements addressing potential <br />damage to and liability for the existing significant man-made <br />structures within the affected area or 200 feet. This <br />includes the powerlines, plus landowner's fences, culverts and <br />gates, field terraces, and county bridges. <br />3. The Mining Map in Exhibit C shows good detail for Phase I, but <br />nothing for Phase II (or III). Please provide your best <br />estimation of details for the depth and direction of mining, <br />stockpile locations, buffer areas, etc., for the west area. <br />Please also show any access points, roads, culverts, etc., on <br />the applicable maps. <br />4. The Mining Map in Exhibit C mentions an Average Topsoil Depth <br />of 7 inches, whereas the exhibit's text states such depth as <br />5 inches, and ranging from 4 to 7 inches. Please clarify. <br />5. Exhibit D mentions an overburden layer at depth of 2 to 10 <br />feet. Exhibit E states that "there will be no spoil." Is <br />this overburden to be regarded as distinct and different from <br />spoil? Please clarify. <br />
