Consulting Engineerwas held <br />in Fort Collins at TST, Inc. offices. The informal conference covered Western Mobile's <br />Loveland Permit for mining, File No. M-2000-034, adjacent to land owned by TMC <br />Waterford Place, LLC which is located in the city limits of Loveland. The purpose of the <br />informal conference was to: <br />• Explain the three hearing process to all parties <br />• Identify the issues <br />• Identify the parties <br />• Determine what issues have been resolved; and <br />• Determine if any parties want to withdraw <br />The issue TMC Waterford Place, LLC has with the permit application to mine gravel <br />is a flood issue. Bruce Humphries informed me the flood issue was not in theirjurisdiction <br />because any affect of the river bank was apre-existing condition and only waters affecting <br />flooding as a part of the permit application for mining in the future was under their <br />jurisdiction. My concern is any alteration of the floodway or flood fringe affects the TMC <br />Waterford Place property which is annexed to the City of Loveland. The floodplain <br />administrator for Larimer County and the City of Loveland has the jurisdiction for flooding <br />issues. The Western Mobile mining permit will be County jurisdiction because the pit is <br />located in the County. <br />As part of a prior Larimer County planning commission meeting a proposed condition <br />of approval was approved by Larimer County for a study of the potential impact of the <br />gravel mining operations of the existing floodplain located on the TMC Waterford Place <br />property. I was informed today Mary Harnett will be providing you and our consultant a <br />copy of the study to see how it may affect our property. <br />
