Consulting Engineerwas held in Fort Collins at TST, Inc. offices. The informal conference covered Western Mobile's Loveland Permit for mining, File No. M-2000-034, adjacent to land owned by TMC Waterford Place, LLC which is located in the city limits of Loveland. The purpose of the informal conference was to: • Explain the three hearing process to all parties • Identify the issues • Identify the parties • Determine what issues have been resolved; and • Determine if any parties want to withdraw The issue TMC Waterford Place, LLC has with the permit application to mine gravel is a flood issue. Bruce Humphries informed me the flood issue was not in theirjurisdiction because any affect of the river bank was apre-existing condition and only waters affecting flooding as a part of the permit application for mining in the future was under their jurisdiction. My concern is any alteration of the floodway or flood fringe affects the TMC Waterford Place property which is annexed to the City of Loveland. The floodplain administrator for Larimer County and the City of Loveland has the jurisdiction for flooding issues. The Western Mobile mining permit will be County jurisdiction because the pit is located in the County. As part of a prior Larimer County planning commission meeting a proposed condition of approval was approved by Larimer County for a study of the potential impact of the gravel mining operations of the existing floodplain located on the TMC Waterford Place property. I was informed today Mary Harnett will be providing you and our consultant a copy of the study to see how it may affect our property.
