Dept. of Natural Resource <br />We have reviewed your letter of March 3, 1982 regarding your questions and <br />comments with respect to the subject application. It is the purpose of this <br />letter to set out comments regarding the issues raised. <br />We are hereby using your March 13, 1982 letter to Siegrist as a checklist <br />and are responding to those items utilizing the same numbering system. This <br />letter may be considered as an amendment to our original application and super- <br />ceding the original where appropriate and applicable. <br />A. Exhibit A-Legal Description. The Weld County Commissioners in the <br />hearing of April 14, approved our request for a gravel mining permit ~4~ <br />on the subject parcel. Weld County has prepared and submitted to your <br />office a statement changing the boundaries of the original permit area. ~t!4~ <br />(Your file N80-149). See Weld County letter dated April 28, 1982 from <br />Greg Oxenfeld. A~ <br />B. Exhibit D - Mining Plan. <br />1. The irrigation company which was known as the Hayseed Ditch is now <br />defunct and the ditch system has been abandoned for many years. The <br />abandoned ditch, which laid approximately on contour, will be replaced <br />with a ditch on grade along the north side of the property which is <br />east of the centerline of Section 35. This new ditch will accept the <br />irrigation tail water from above and carry it easterly on the Siegrist <br />site with discharge to the river being made along the easterly end n K <br />of the Siegrist property. Historically, the irrigation tail water <br />and runoff from the north above the site was diverted around this <br />area and we simply expect to continue that historical use. <br />2. No direct discharge of water to the stream is anticipated as a result <br />of the dewatering operation for this gravel mine. Please refer to <br />the second paragraph under Exhibit G-Water Information, page 5, of <br />our original application. As stated therein, water from dewatering <br />operations will be pumped into two major existing ponds; one on the <br />
