If these ponds Q/C <br />are insufficient, additional ponds of 1-1/2 to 2 acres in size will <br />be excavated in areas to be mined for the specific purpose of receiving <br />dewatering water. The water in these ponds is expected to seek the <br />level of the normal groundwater in the area. <br />3. There are no water wells located within 200 feet of the permit ~ ~ <br />boundaries. <br />4. The dewatering operation will not effect the Hayseed Ditch. That <br />ditch has been abandoned and is no longer in use. The Siegrist <br />Company prepared a letter to the Last Chance Ditch owners wherein <br />they agree to protect the Last Chance Ditch operation from any losses <br />due to the dewatering operations. Such protection may mean sealing ..o <br />or lining of the Last Chance Ditch in the area of the dewatering ~' <br />operations. It is also possible, due to the size of the area being <br />permitted for gravel mining, that the operations could be scheduled <br />such that dewatering would not occur adjacent to the Last Chance Ditch <br />during the irrigation season. As Siegrist approaches that time, these <br />matters will be addressed and upon any proof of damage, the Last Chance <br />Ditch will be protected. <br />5. The law protects each of the owners of permanent valuable man-made <br />structures located within 200 feet of this operation and the Siegrist <br />Company recognizes that protective right. A meeting with the Colorado <br />Highway Department to discuss their concerns and to provide any ad- Oir <br />di tional assurances to them against the possibility of any damage, <br />was held. The Colorado Highway Department has prepared letters stating <br />that they do not object to our gravel mining operations and believe that <br />their facilities will be properly protected. <br />There are two gas wells on the site along with some pipelines. <br />Lease agreements exist with the owners of the land giving certain rights <br />to both parties. By virtue of those lease agreements, protection of <br />the lessee is granted and should damage occur as a result of landowner <br />operations, liability is placed upon the operator. ". <br />The Panhandle Eastern representatives appeared at the hearing of <br />the Weld County Planning Commission and stated that they have no ob- <br />jection to the gravel mining operation provided such operation occurs <br />in accordance with the lease agreement of record. <br />6. The operator will replace topsoil on disturbed areas upon completion <br />of the operations. All topsoil to be salvaged and stockpiled for ~'~ <br />future replacement will be removed, using scrapers, to high ground <br />on the north side above the 100-year flood plain level. The topsoil <br />which is removed and salvaged along the south side of St. Vrain Creek <br />will be placed along the south boundary of the property. <br />
