I <br />will respond to the questions in the same numerical order as your <br />letter. <br />1. We cleared up the discrepancies between the plans and the <br />I/ notes about the setbacks. Also we have included a cover note <br />which says that our setback will be 200 feet from the gas <br />well, Lupton Bottoms Ditch, and electric utility poles until <br />we are able to provide a written agreement. <br />In our other applications to Weld County, the County has <br />always asked for the setback to the edge of mining from the <br />property line. We have been allowed by the Weld County Zoning <br />Inspectors to put overburden and topsoil stockpiles along the <br />property line. <br />2. This stretch of the South Platte River has never been studied <br />to determine the 25 year flood event. Only the 100 year flood <br />event has been mapped. To determine the 25 year flood event <br />would require extensive engineering calculations which is <br />unreasonable for this application to bear. We have sized our <br />side channel spillways to handle the flood in a reasonable <br />fashion and also in order to avoid the excavation and <br />destruction of wetlands along the South Platte River. <br />3. Our calculations indicate the Phase I and II mining areas are <br />about 45 acres. The stockpiles as noted on Exhibit C could be <br />5 acres for a total of 50 acres. Our Table of Disturbance in <br />Exhibit D indicates the maximum disturbance that could occur <br />at any one time considering concurrent reclamation. By <br />avoiding some wetland areas and revising the Mining Plan we <br />believe this Table of Disturbance may even be less. <br />The access road into the asphalt plant is much shorter and the <br />scale has been combined into the area of the asphalt plant. <br />We may now be talking about an area less than 32 acres. <br />
