Pinnacle Pines, LLC is the owner of 141 acres and will close on another 30
acres, known at the Myers Farm this month. Both properties are immediately adjacent to Tanabe
property. Pinnacle Pines LLC, in partnership with Gary Williams Real Estate, Inc., received
approval to develop a total of 171 acres for 1,000 residential units and neighborhood
commerciaVretail uses. This site was annexed to Commerce Ciry and zoned PUD Mixed Use in
February of this yeaz. The application prepazed by Tuttle Applegate, Inc. inaccurately identifies
the zoning of the adjacent property as agriculture.
It is extremely important that the highest level of care be given to all proposed mining permits
outside of Adams County designated zone of valuable minerals. Upon reviewing the application,
I have the following concerns about the health and safety of the proposed mining permit:
• Exhibit C -The application does not specifically address surface irrigation facilities.
How and by what methods will surface irrigation occur?
• Exhibit D -The application suggests gravel cuts up to 25 feet deep at ''/s:l slopes. This
will most likely expose ground water with potential contaminates. Has the applicant
tested the ground water for contamination, such as DIMP, Methyl Chloride, Pazathion,
DDT, Malathion, Ethyl Benzine and Xylen? What aze the results of ground water tests?
Can all ground water test results be made available to adjacent property owners before
any decisions aze made by the Division of Minerals and Geology on the Tanabe
application?
