' } ~ III III IIIIIIIIII III <br />999 m-ga-lad <br />December 8, 1980 <br />Mr. Oran Burmwood <br />Chairman Commisioner <br />Crowley County <br />6th 5 Main <br />Ordway, Colorado 81063 <br />RE: Sand and Gravel or other Mining Operations Operated by <br />Your County. <br />Dear Mr. Burmwood: <br />In reviewing our county files, it was found that your county has not submitted <br />applications for, or received permits for, any sand and gravel operations under <br />the Colorado Mined Land Reclamation Act of 1976. Most counties in the state <br />do operate a number of pits to supply materials for county road maintenance. <br />The reclamation Zaw (34-32-IOI et. seg., CRS 1973 as amended) states that any <br />operator (which includes counties) proposing to engage in a mining operation <br />must first obtain a permit from the Mined Land Reclamation Board. <br />If your county does not operate any mining operations, please inform us for <br />the record. If, however, your county does operate any pits, you should under- <br />stand what is required and the special provisions in the law for counties. <br />As you probably know, the Colorado Legislature passed BB 2182 during the 1979 <br />Session of the legislature. This Zaw amended the Colorado Mined Land Recla- <br />mation Act in several ways which directly affect mining operations conducted <br />by counties. Enclosed is a copy of the Complete amended law with the new <br />provisions of 1182 included. <br />SUMMARIZING THE MAJOR PROVISIONS OF BB II82 <br />Applicable to limited impact (less than 10 acres) operations (34-32-110) <br />1. Counties may submit one composite application and annual report for aZl <br />similarly situated :;and, gravel, or quarry operations. <br />2. No application or annual fee will be required of counties. <br />Applicable to regular (more than 10 acres) operations (34-32-112) <br />1. No application, renewal or amendment fee is required of counties. <br />
