No surety will be required of counties if the counties submit a written
guarantee stating ghat the affected lands will be reclaimed in accordance
with the terms of i:he permit and applicable state Zaw.
In addition, we are enclosing a copy of the rules and regulations for your
convenience, and copies of application forms.
Under the current Zaw, i.t is not difficult or costly for a county to obtain
a permit. Much of the information needed for an application exists and needs
only to be pulled together from the various sources such as the Soil Conservation
Service and Colorado Division of Wildlife. The Mined Land Reclamation Board
is not so concerned about who get the permit as they are that all mines are
permitted and that adequate reclamation is occurring at all sites. It may be
that some of your source's of aggregate will need to be permitted by you while
others should be permitted by the landowner or a contractor. These are your
decisions on which we can advise you if you request it.
If you or your staff hac•e any questions concerning the Zaw of necessary
procedures for coming iriEO compliance, please feel free to contact me or any
of my staff. We will ber happy to give you guidence in the preparation of
applications or meet with you to discuss any problems unique to your currently.
In any case, may we please hear from you in the near future so as to clear up
any problems or misundez•standings which may exist.
Sincerely,
David C.
