Lochhead <br />Execolive Director <br />Michael6 Long <br />Drvrsion Duecmr <br />This letter summarizes the items in the above-named application <br />which were found during the adequacy review to need further <br />clarification. The comments listed herein are arranged by the <br />exhibit in which they should be found. Where an exhibit is not <br />listed, there is no item needing to be addressed at this time. I <br />have tried to be as inclusive as possible, in order to reduce the <br />number of separate letters necessary during this review period. <br />Please comment on or provide clarification for each of the <br />following items: <br />APPLICATION FORM - PAGE 3 <br />We have received the revised page 3. The method of mining <br />indicated is changed from "quarry" to "open pit," which is more <br />appropriate for this operation. However, there are two present <br />land uses and two future land uses indicated on this page, instead <br />of one in each category. We are regarding "Rangeland" as the <br />primary present land use, and "Solid Waste Disposal" as the primary <br />future land use. If a different present and/or future land use <br />should be regarded as the primary one (since the form requests that <br />one be chosen), please let me know. Without comment from you, <br />these will remain as the primary land uses of record. <br />EXHIBIT A - LEGAL DESCRIPTION <br />The metes and bounds description included in this exhibit is taken <br />verbatim from the survey plat prepared by Shy Surveyors. (The plat <br />is part of Exhibit C, and will be discussed below.) The <br />description is not adequate, in that it does not describe the <br />entire 38.46-acre permit area, nor is it actually correct for <br />describing only the 9.95-acre Phase I area either. What is <br />required for this exhibit is a description for the entire permit <br />area. What are the figures to be considered as the total permit <br />area, and of each of the phases? There are different total <br />acreages cited throughout the application, for the total and the <br />separate phases, and these should be more precise and consistent. <br />
