The <br />Decision Date has been set by Rule for April 6th, 2006. A Preliminary Adequacy Review (PAR) by the <br />Grand Junction Field Office staff has resulted in the following issues needing correction or clarification. <br />Please address the following: <br />1) All maps cut off the permit boundaries along the northern edge. Please submit new maps that <br />depict the entire permit boundary area along with the correct information required by Rule such <br />as adjacent landownership, etc. <br />2) The maps must contain the haul road within the permit boundaries from the site to 32 Road. <br />3) The Mine Plan denotes a 30-font setback from adjoining property lines. Does this include the <br />haul road? Please clarify. <br />4) The Mine Plan calls for the mining of materials down to the Mancos Shale contact. The Division <br />requires a minimum of two feet of cover be maintained at all times over the shale. The <br />requirement is to reduce the exposure of the shale to the environment because of selenium issues. <br />Please commit to maintaining a minimum cover of two feet of material above the shale contact <br />point. <br />5) The Mine Plan calls for concurrent reclamation of one block as excavation continues in the next <br />phase. Please clarify how access to Phases 4 through Bare to be maintained. A brief statement <br />of the road is made. But for reclamation liability estimates, staff must know the approximate <br />width and path of the road into these areas. <br />6) Please clarify that slopes are to be backfilled upon excavation completion. An estimate of the <br />maximum total length of exposed highwall should be provided. <br />7) Please strike "vegetation is guaranteed for 3 years" from the Mine Plan text. The Division and <br />BLM will have to concur on vegetation establishment and success and it may or may not extend <br />beyond 3 years given the geographical and environmental factors for the site. <br />8) Topsoil must be protected from erosion by some means if its left in place for longer than 1 <br />growing season. The Division recommends using the approved seed mix.
