McArdle: <br />From your recent correspondence, it is my under- <br />standing that the Board has continued the above mentioned <br />applications to the February 24 and 25, 1982 meeting. We <br />are also aware that you have received a letter dated <br />January 28, 1982 from Gene W. Eide, District Ranger of the <br />San Isabel National Forest here in Leadville, requesting that <br />the granting of the hiined Land Reclamation permit for the <br />West Tennessee Pass gravel pit be withheld until the applicant <br />has fully complied with the requirements and regulations of <br />the U. S. Forest Service. The applicant does not concede <br />that the Forest Service has any jurisdiction over the surface <br />use of this land at this time by reason of the fact that the <br />claims were located well prior to the Multiple Use Act and <br />further by reason of the fact that there is presently pending <br />a U. S. Patent Application ~oith the Bureau of Land I4anagement <br />on these particular claims. <br />We further are of the understanding that you have been <br />working with our representative, Mike Henderson, in regard <br />to the additional information requested in your correspondence <br />of early December.
