The COUNTY owns or has the right to rossession to 527 acres of ground adjacent to the Adams County Regional Park ana the COUNTY has the right to extract sand and gravel and other minerals on approximately A50 acres of said tract as designated by Exhibit A. 2. The COi~1PANY has the equipment, manpower, and other resources to competently extract the sand and gravel from said trace and is willing to do so upon the co^ditions here- inafter set forth. 3. The COUYdT„ as the landocaner, will obtain the nec- essary zoning for the extraction of sand ai.d a~,riav.~l from the tract and the CO!dPANY will make applic tion to the State of Colorado for a permit for such extractic~n,~ ~..,~.,.. ...r.re:.r....,.~. 4. The COMPANY and the COUNTY will jointly prepare the necessary gravel extraction plans and the plans for reclama- tion of the area following such extraction. The COU27TY will determine the configuration of the lake, the shape and location of landforms, and the sloping for the shoreline. The CUUNTY will also provide the revegetation plan, wildlife narrative, ar_d narrative describing the final after-use. The COMPAIIY will be responsible for fencing (the area designated pursuant to paragraph 11), grading, sloping, and contouring. All opera- tions by the CODiPANY will he sLCh as to conform to the configu- rations, plans, and standards of the COUtdTY. 5. The COMPANY w: commence mining operati~~is as soc.. as practicable after the issuance of the permit. It is con- templated by the parties that such operations will begin in tdovember, 1977, but the COMPAPIY will commence operations within 30 days after receiving written notice from the COU?7TY.
