OF FORT LUPTON APPROVING A SPECIAL <br />USE PERMIT FOR SW TKO (AKA LUPTON LAKES) TO OPERATE A GRAVEL PTT <br />MINING OPERATION. <br />WHEREAS, the Planning Commission held a public hearing on December 14, 2004 to review the <br />Special Use Permit and stafffindings and recommendations; and <br />WHEREAS, after review of the application and consideration of the public hearing testimony <br />recommended approval of the Special Use Permit and that the applicant comply with current City Code; <br />and <br />WHEREAS, the City Council held a public hearing to consider the request for a Special Use Permit on <br />February 9, 2005, which was continued to February 18, 2005 and March 2, 2005; and <br />WHEREAS, the proper public notification requirements including legal publication were met for the <br />Special Use Pemut hearing; and <br />WHEREAS, after consideration of public testimony and staff findings the City Council approves the <br />revised request for a Special Use Permit subject to conditions as follows: <br />a) Noise: Every effort wIIl be made to minimize the impacts of noise. The applicant shall <br />follow the recommendations set forth in the noise impact study. The following decibels <br />(dhA) vrill apply and-adhere fa Colorado Standards:Fnr daytime haucs_(ahicli shall b~ <br />defined from 6: 00 A.M. to 6:00 P.M•) the decibels shall not exceed 55 db(A) and for <br />nighttime hours (which shall be defined from 6:00 P,M. to 6:00 A.M.) the decibels shall <br />not exceed 50 db(A). All gravel mining equipment including, but limited to trucks that <br />am equipped with reverse beepers will take measures to reduce the sound levels, however <br />safety standards shall be maintained. <br />b) Dust: Dust contrgl measures will be taken on interior roads. These measures include but <br />are not limited to applying water orstate-approved dust suppressant chemicals <br />periodically. Fugitive dust emissions shall meet state air quality standards. <br />c) Sam: Gravel Pit equipment operators and truck drivers will adhere to the best safety <br />practices in and around the site when transporting materials. Truck unit identifications, <br />telephone numbers and license plate numbers will available to the City upon reasonable <br />request. <br />d) Traffic: Truck traffic is limited to WCR 6 and is not permitted on WCR 27 or any other <br />County Road (WCR 6'/s, WCR 8'/:, &WCR 10) unless the trucks are delivering locally. <br />The Colorado Department of Transportation indicated that the intersection of WRC 6 and <br />SH 85 will need an access permit.
