Oehler, Environmental Protection Specialist ~+,.Y ~~~ <br />RE: File No. M-97-054, Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy the applicable <br />requirements of C.R.S. 34-32.5- 1 O1 et seq. and the Mineral Rules and Regulations of <br />the Mined Land Reclamation Board: <br />EXHIBIT C -Pre-Minine and Minin¢ Plan Mans of The Affected Lands <br />You have marked the permit area boundary with a heavy dark line on your Pre- <br />Mining Plan Map. In accordance with Rule 6.2.1 (d), identify the line either on <br />the map or the map index. The Pre-Mining Plan Map should be relabeled Pre- <br />Mining/Mining Plan Map since it shows the mining operation as well as pre- <br />mining conditions. This information can also be provided on two separate maps. <br />We have taken the latter option of presenting separate maps for the Pre- <br />Mining Base Map and the Mining Base Map. See Exhibit C. <br />Z. Please identify the owner of the lands immediately south of the proposed permit <br />boundary and within 200 feet of lands to be affected by the mining operation. <br />This is the land on the Pre-Mining Plan Map displaying no ownership symbol and <br />lying along the route of the Arkansas River between land belonging to Mark <br />Brown and the east map boundary. <br />This land is part of the Harvey Ranch under option by Agile. The owner will <br />be Agile or its designated ranch operating entity. <br />3. Are there any utilities located in the railroad right-of--way. If so provide <br />information in appropriate exhibits. <br />There are no utilities located in the railroad right of way built for the project. <br />The existing railroad right of way is outside of the permit boundaries. The <br />poles and lines in the railroad right of way are outside the permit area, <br />owned by the railroad and are for railroad purposes only. <br />
