Dear Ms Simpson: Thank you for informing the Colorado Division of Minerals and Geology (DMG) of your concerns regarding the Delta Paving Gravel Pit application, submitted by Grand Junction Pipe & Supply Company. DMG received your letter of objection, dated 2123/99, on 2/23/99, prior to the close of the public comment period. In response to the timely objections, DMG has scheduled a Formal Public Hearing before the Colorado Mined Land Reclamation Board (Board), for consideration of application, to occur during the April 28-29, 1999 Board meeting in Denver. Additionally, DMG will schedule an Informal Conference, to occur in the Delta area subsequent to the close of the public comment period, and aPre-Hearing Conference, to occur in the Delta area prior to the Formal Public Hearing. Specific dates, times and locations for the public meetings and hearing will follow under separate mailing. The public meetings and hearing will occur unless DMG receives written withdraw of objection from all objecting parties. DMG has reviewed your 2(23/99 objection letter and offers the following response. Your comments are identified by bold italics print; DMG response follows in standard print. References to the statute or Act are from the Colorado Land Reclamation Act for the Extraction of Construction Materials, 34-32.5-101 gt ~., C.R.S. (1995 Repl.Vol.). References to the Rules are from the Construction Material Rules and Regulations of the Colorado Mined Land Reclamation Board, effective 1(96. 1. Heavy trucks (never covered) would be pulling out onto State Highway 65just north o/the junction with State Highway 92. Highway 65 is a narrow two-lane highway, heavily traveled and large/y by senior citizens who have lived in this area, including Cedaredge, al/ of their lives. They fend ro drive slowly and cautiously on a highway that was until the last two or three years lightly traveled. Please be advised that DMG authority is limited to enforcement of the Act and Rules.
