<br />Response to Faye C. Simpson <br />Delta Paving Gravel Pit <br />File No. M-98.105 <br />Page 2 <br />Act and Rules do not appear to address traffic safety or demography issues. Therefore, <br />these issues do not appear to be within DMG jurisdiction. Traffic safety and demography <br />issues may be appropriately addressed by the Delta County governing authority, or the <br />Colorado Department of Transportation. <br />2. Highway 65 is a Scenic Byway over Grand Mesa. <br />DMG has not received comment from any local, state or federal agency indicating possible <br />conflict with the application and laws governing Scenic Byways. Additionally, the Act and <br />Rules do not appear to address this issue. Therefore, this issue does not appear to be a <br />jurisdictional issue for DMG. This issue may be appropriately addressed by the Delta <br />County governing authority, or possibly by the Colorado Department of Transportation. <br />3. The eighty-one acres of farmland and along the river a favorite wildlife habitat. Bald and <br />go/den eagles, hawks, blue herons, foxes, and deer among the creatures calling it home. <br />The Rules require that the application address wildlife issues and that the application be <br />reviewed and commented upon by the Colorado.Division of Wildlife (DOW-. The DOW <br />wildlife statement, included in the application, indicates a great diversity of wildlife species <br />present. However, the DOW statement also indicates that measurable impacts to wildlife, <br />resulting from the proposed operation, will be reduced or eliminated due to the method of <br />mining and reclamation proposed in the application. <br />3. Peop/e living in nice homes on the mesa above the river, paying plenty of state property tax, <br />are not yet aware of the impact the noise, dust, and deso/ate, ug/y /and being exp/oiled will <br />have on their lives. <br />The application file indicates that all public notices and publications have to date occurred <br />in accordance with the requirements of the Act and Rules. <br />The Act and Rules do not appear to address noise pollution, dust pollution, and issues <br />described as desolate, ugly land being exploited. Therefore, these issues do not appear to <br />be within DMG jurisdiction. Noise pollution and quality of life issues may be appropriately <br />addressed to the Delta County governing authority. Dust and air pollution issues are <br />appropriately addressed by the Colorado Department of Public Health and Environment, Air <br />Pollution Control Division, 4300 Cherry Creek Drive South, Denver, CO 80222. <br />4. There are a/ready three grave/ pits right in the genera/ area, one of them belonging to Grand <br />Junction Pipe and Supply. <br />
