The Act and <br />Rules anticipate that public and private lands will be affected where minable resources <br />exist. However, the Act and Rules provide reclamation requirements to ensure that <br />affected lands are reclaimed to a beneficial land use. The Act and Rules do not appear to <br />specifically restrict the number of permitted operations within a mineral rich area. <br />Therefore, this issue does not appear to be within DMG jurisdiction. This issue may be <br />appropriately addressed to the Delta County Planning Department. <br />4. This operation cou/d Iasi as long as thirty years. <br />The application estimates that the life of mine will be 10-15 years. However, the Act and <br />Rules state that an operator shall not be required to meet specific dates for initiation, or <br />completion of a mining phase as may be identified in the timetable. A permitted operation <br />may continue, providing the operation remain in compliance with the approved permit <br />conditions, the Act and Rules. <br />5. l have seen the so-ca/led restoration and reclamation done by this company. /t is a far cry <br />from the /ove/y picture painted b y their spokespeople. One visit from the Mined Land persone/ <br />could verify this statemenf. <br />As noted above, the Act and Rules provide reclamation requirements to ensure that <br />affected lands are reclaimed to a beneficial land use. Any operator of a permitted <br />operation is obligated to satisfy the performance standards of Rule 3.1. Financial warranty <br />cannot be released and the permit terminated until reclamation has been completed in <br />accordance with the performance standards of Rule 3.1, and in accordance with the <br />approved reclamation plan, and all applicable sections of the Act and Rules. <br />6. There are protected species of fish in that river, a/ong with flout. A law suit by the Nations/ <br />Wi/d/ife Federation or any conservation group would stop the project, or at /east cost the <br />gravel company in /ega/ fees. <br />DMG has not received comments from wildlife agencies, indicating conflict with wildlife <br />laws for the proposed operation. <br />As noted above, the application includes a wildlife statement from the DOW. The <br />statement provided by DOW includes recommendations for minimizing potential impacts to <br />fish and fish habitat. DMG has requested that the operator provide additional information <br />to the application, clarifying how the proposed operation has addressed DOW <br />recommendations. <br />
