The Division of Minerals and Geology (Division) is required <br />to make an approval or denial decision no later than February 1, 2006, therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated <br />in the local newspaper, all owners of record of surface lands, easement holders, and owners of record <br />of surface lands that are within 200 feet of the boundary of the affected land. Proof of notice may be <br />return receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Minine Plan Maps <br />2. Exhibit C-1 depicts a number of ditches and roads on the property that will be mined through. Please <br />state the owners/easement holders of the structures, and provide notarized consent agreements to <br />mine through the structures. As an alternative, the applicant can commit to maintaining a 200-foot <br />mining off set distance, or provide an engineering evaluation to mine closer than 200 feet. <br />3. There is reference to three wetland areas (A, B, and C) in the application. Please locate these areas on <br />the Pre-Mining Plan Maps. <br />Rule 6.4.4 Exhibit D- Minin¢ Plan <br />4. Please state the overall depth of the pits and indicate on the exhibit(s) the direction of mining. <br />5. Please list and locate on the applicable exhibit all structures that will be constructed on site (i.e. <br />plants, offices, trailers, tanks, conveyors, etc...) and provide their associated dimensions and <br />composition in order to accurately estimate a cost for removal in the reclamation bond estimate. <br />6. The applicant states that an asphalt plant and concrete batch plant will be erected on site. Please <br />describe how the facilities will be managed to ensure groundwater and surface water will not be <br />impacted. Please describe the nature and storage location for all hazardous waste that will be used on <br />site. <br />7. Please describe all haul roads that will be utilized for the mining operation. Rule 6.3.3(8) requires the <br />applicant to specify the dimensions of any existing or proposed roads that will be used for the mining <br />operation. Any improvements necessary on existing roads and the specifications to be used in the <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geologiral Survey <br />
