construction of the new roads needs to be described in the permit and included as part of the <br />permitted acreage. The applicant will also need to address reclamation of any new or improved roads <br />constructed on site. <br />8. Please state how pit runoff will be diverted to the two silt ponds located on the north end of the mine <br />site. Please further explain their use, management, and how water will be diverted into the silt ponds <br />and provide any ditch or conveyor designs if applicable. <br />9. The applicant noted the location of topsoil piles to be stored on site. However, overburden piles were <br />not depicted on the exhibits. In accordance with Rule 3.1.9(1), topsoil and overburden must be <br />segregated and stored separately. Please revise the exhibits to depict the location of all overburden <br />piles in Phases 1, 2 and 3. <br />10. The applicant proposes a sediment pond to be constructed in the processing area. Please describe in <br />further detail the construction, dimensions, use and management and of this pond. Please explain <br />how water will be routed to the pond, and any dischazges features to be installed. in addition, explain <br />how the pond will be reclaimed. <br />11. Please locate and describe in further detail the dewatering trenches that will be constructed to <br />facilitate dewatering of the site. Provide the sizing of the trenches and the point of discharge. <br />12. Please provide additional detail and designs on construction of the slurry walls around Phases 2 and 3. <br />Please include the dimensions and composition of the slurry walls and state if they will be connected <br />via ditches or pipelines. <br />13. Please describe the azea identified as "The Nobile Oil and Gas Operations Area" located on Exhibit <br />C-3. Please state if any structures are located on the property, or if the azea will be affected by the <br />mining and reclamation operation. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />14. Please further explain the additional backfilling that will take place around wells ME 111 and the Top <br />Operating when mining of the pit is complete. <br />15. Two of the pits will be reclaimed into water storage reservoirs. Please state what surface water rights <br />exist or will be used to divert water into the ponds to achieve the post mining land use of developed <br />water resources. <br />16. in accordance with Rule 6.4.5(2)(d), please state the proposed riming of seeding and planting. <br />Rule 6.4.7 Exhibit G- Water Information <br />17. Please provide an estimate of the project water requirements including flow rates and annual volumes <br />from the development, mining and reclamation phases of the project as required by Rule 6.4.7(3). In <br />addition, please submit a copy of the source of the water rights obtained by Asphalt Paving to supply <br />the project water requirements for the mining operation and reclamation. <br />18. Please explain how water from dewatering of the Wattenberg West Pit will be managed to protect <br />against pollution of surface of groundwater both during and after the mining operation (Rule <br />6.4.7(2)(c)). <br />19. The applicant stated that baseline water levels for the monitoring wells were included with the <br />application. The Division could not locate the data. Please re-submit the baseline water level data to <br />the Division. <br />
