Box 17304 <br />Boulder, CO 80308-0304 <br />RE: Third Party Comments Received, Gold Hill Mill, File No. M-94-117 <br />Dear Mr. Hartley: <br />Please find enclosed a copy of correspondence from the Committee on Mining <br />and the Environment, Gold Hill Town Meeting, Inc. (Committee) regarding <br />the above referenced application. This is provided to you in accordance <br />with Rule 1.7 of the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board. Rule 1.7 also requires that the Division of Minerals <br />and Geology consider third party comments received in the review of a <br />permit application. The Committee has raised a number of pertinent issues <br />that will have to be adequately addressed before the permit application <br />can be approved. These critical issues are listed below. <br />1. Given that a loss of containment has occurred through the door at <br />the northwest corner of the mill building, the Division concurs with <br />the Committee that measures need to be implemented to prevent a <br />reoccurrence. Such measures could be installation of a concrete <br />sill such as that proposed for the man-door in the lower part of the <br />building. <br />2. The Division concurs the Committee that water and other lines should <br />be checked prior to mill start-up after a period of inactivity. <br />Please commit to pre-operational inspection and testing of all <br />critical systems prior to mill start-up, and commit to recording all <br />pre-operational inspection observations in the mill log book that <br />COM, Inc. has previously agreed to maintain. <br />3. The Committee has raised the issue of erosion prevention on the <br />downstream tailing embankment face. It is the Division's view that <br />the prudent erosion prevention method for the dam face is to <br />implement the approved reclamation plan on this area upon completion <br />of embankment construction. Please commit to such implementation. <br />4. As you know from previous correspondence, the Division shares the <br />Committee's concern that topsoil be effectively salvaged at the <br />
