The following is our response to the thirteen <br />(13) items listed as adequacy issues: <br />Exhibit B -Site Description <br />1.) The only fence which exists within 200 feet of the Permit Boundary is within D 1/4 Road <br />right-of-way scheduled to be relocated during the improvement of D 1/4 Road for <br />Upland Estates Subdivision.(Not Permanent) <br />No water mains presently exist within 200 feet of the Permit Boundary. <br />The water storage pond is owned by the applicant . Revised surface elevation moves <br />the pond beyond 200 feet of the Permit Boundary. <br />D 1 /4 Road is the only County Road which presently exists within 200 feet of the Permit <br />Boundary is scheduled for improvement during development of Upland Estates <br />Subdivision.(Not Permanent) <br />2.) No County Road easement for 35 Road exists until dedication by Upland Estates <br />Subdivision. <br />Exhibit C -Mining Plan <br />3.) Approximately 7 acre feet will be used annually which includes reclamation and dust <br />control. The storage pond will be used as the source during irrigation season. <br />Conditional water rights have been granted to Gary Rinderle by Colorado Division of <br />Water Resources -Case No.000W23. <br />A supplemental water source will be available from Ute Water District when mains are <br />installed for Upland Estates Subdivision. <br />4.) All of the proposed structures are portable. No permanent foundations or footers are <br />proposed. <br />5.) Pits and soils studies have not identified the contact line to be hard shale. However, <br />we will commit to salvage of crusher fines, screening fines and sediment pond cleaning <br />to be replaced a minimum of 4 inches thick over the site at reclamation as a growth <br />medium. The "stock piling" of the salvaged material shall overlay Unit 9 until needed <br />for Units 1 and 2. Additional top soil will be available from overlot grading of Lots 7, 8 <br />and 9 which will not be developed until after the gravel is depleted. <br />
