Lnng <br />Division Dveclor <br />Re: Adequacy Concerns, Monazch Quany Permit Application, File No. M-2000-098 <br />Deaz Mr. Sandell: <br />The Division completed a technical review of the referenced permit application. Following are <br />items of concern which must be addressed in order to meet the minimum requirements of the <br />Act/Rules. L` a portion, or all, of a Rule is not listed, it has been addressed: <br />1. Rule 6.2 -General Requirements of Exhibits -specifically, requirements for the maps must <br />conform to the following criteria; <br />d) identify and outline the azea which corresponds with the application. The maps that were <br />submitted only show the Colorado Lime Company (CLC) property which appears to <br />contain less acreage than the proposed permit area. The applicant has applied fora 298.7 <br />'} acre permit but the legal location description only describes 197.34 acres in the CLC <br />~ property azea (Sections 4 & 33). Also, the various maps show different property <br />t <br />~:~' ~ configurations (the air photo overlay map is not the same as the Exhibit A and B maps). In <br />,~ addition, it appears there are a few acres of Forest Service managed lands within the CLC <br />property outline. If Forest Service managed lands are located within the proposed affected <br />land areas, CLC must provide documentation demonstrating right of access to the acreage. <br />And the acreage must be shown on all the maps. <br />e) the maps must contain the appropriate title. For instance, does the air photo overlay <br />represent Exhibit Cpre-mining map, mining plan map or Exhibit F reclamation plan map? <br />2. Paragraph 12 of the application should include blasting as part of the method of mining. <br />3. Rule 6.4.1 - Exhibit A -describes 216.43 acres of patented mining claims located in Section 4, <br />Township 49 North, Range 6 East and Sections 22, 23, and 33, Township 50 North, Range 6 <br />East. Plus 10.83 acres comprising the Monarch Townsite. This amounts to 227.26 acres. <br />However, [he property outline around the quarry area in Sections 4 and 33 appears to only <br />contain 197.34 acres. Two patented claims (Ben Boldt and Paymaster) lie southeast of the <br />
