Higgins <br />Route 1, <br />838 Rapid Creek Road <br />Palisade, Colorado 81526 <br />Re: Roadside and Cameo Mines - File No. C-041-81 <br />Dear Mr. Higgins and Concerned Rapid Creek Residents: <br />The Mined Land Reclamation Division has completed its review of the <br />Roadside and Cameo Mines permit application submitted by Powderhorn <br />Coal Company. The proposed decision to approve the permit application <br />will be published in the Grand Junction Daily Sentinel sometime during <br />the week of November 29 - December 3, 1982. <br />Since the review has been completed, it is now possible to explain how <br />your 6 concerns presented in you letter of April 10, 1982 are addressed <br />in this approval. Each concern is addressed below following the order <br />in your April 10, 1982 letter. <br />1) No additional surface distrubance is allowed as part of this <br />approval. If Powderhorn Coal Company proposes any additional <br />disturbance, approval must be received from this office prior <br />to initiation of the disturbance, plus the public will be able <br />to request a hearing on the proposed disturbance. <br />According to the mine plan, subsidence may occur over certain <br />mined sections. None of these mining sections are located <br />below any facilities. The channels of Rapid Creek and Cotton- <br />wood Creek will be protected from subidence by limited extrac- <br />tion of coal under areas where subsidence could affect the <br />integrity of the channels. <br />2) As previsously discussed, there should not be any effect on <br />the quantity of water flowing in Rapid Creek and Cottonwood <br />Creek due to subsidence. In addition no surface disturbance, <br />associated with the mining operation, is to take place within <br />the Rapid Creek and Cottonwood Creek watersheds. Therefore, <br />there should be no lessening of the water quality in Rapid <br />Creek or Cottonwood Creek. <br />
