Higgins -2- December 3, 1982 <br />Powderhorn Coal Company is required to continuously monitor the <br />flows in Rapid Creek and Cottonwood Creek above and below the <br />area to be mined. In addition, Powderhorn is required to monitor <br />the alluvial groundwater of Rapid Creek and Cottonwood Creek and <br />monitor any water in flows into the mine workings. With this <br />monitoring system if any unforeseen effects on Rapid Creek or <br />Cottonwood Creek were to occur, they would be quickly detected. <br />Powderhorn has been required to submit a contingency plan for <br />mitigation of any unforeseen effectson Rapid Creek and Cottonwood <br />Creek. <br />3. Construction of an airshaft and ventilation fan in the Rapid <br />Creek/Cottonwood Creek area is not included within this approval. <br />Before Powderhorn can construct any additional facilities, <br />approval must be received from this office. Also, any concerned <br />citizen may request a hearing before the Mined Land Reclamation <br />Board if they object to the construction of any new facility. <br />A legal notice will be published in the Grand Junction Daily <br />Sentinel any time Powderhorn requests approval to construct a <br />new facility. <br />No additional air pollution is allowed as a result of the addi- <br />tional mining activities. Powderhorn Coal Company is required <br />to obtain and comply with air quality emissions permits from the <br />Colorado Department of Health. <br />Based on the mine plan submitted by Powderhorn Coal Company, the <br />Rapid Creek road should not be used as an access road for the <br />mining operation with the exception of monitoring activities. <br />However, the Mined Land Reclamation Division has no jurisdiction <br />over the use of any public road. If this becomes a problem, I <br />believe the County Commissioners of Mesa County will have <br />jurisdiction. <br />Powderhorn Coal Company is responsible for mitigating any direct <br />effects from their mining operations on private property. Any <br />indirect effects, such as the location of the mine relative to <br />private property, are complex and are beyond the jurisdiction of <br />the Mined Land Reclamation Division.
