Stipulation No. 9 will be resolved in this letter and <br />a status of the resolution of stipulation No. 7 will also be <br />addressed herein. A meeting will be held between CMLR and Peabody <br />representatives on Wednesday, August 7, to either resolve or <br />further clarify the remaining stipulations in question. <br />Stipulation No. 9 addresses a requirement for a site specific <br />survey for threatened or endangered plants on the proposed permit <br />area. In 1983, the vegetation baseline study was updated and <br />included a survey of threatened and endangered species. Due <br />to our oversight during the revision and rewrite of the vegeta- <br />tion baseline report, this information was left out. <br />During the 1983 vegetation baseline study update for the Seneca <br />II-W Mine, an extensive effort was made to augment and revise <br />the species list as well as search for threatened or endangered <br />species. This included a spring flora trip and a walk-through <br />of the tie-across haul road route. In 1985, as part of the <br />verification study for the realigned tie-across haul road route, <br />further investigations for threatened or endangered species <br />were done. All investigations found no evidence of threatened <br />or endangered species occurring on the areas in question. <br />Furthermore, the January 1984 listing for "Plant Species of <br />Special Concern" published under the Colorado Natural Heritage <br />Inventory was consulted to confirm the above findings. It should <br />be noted that Carex microptera is listed as a species present at <br />Seneca II-W. The voucher speciman for the above species is held at <br />
