Box 980 <br />Carbondale, Colorado 81623 <br />Re: Comrrents Concerning North Thompson Creek Application <br />Our File No. C-025-81 <br />Dear Steve: <br />The Division has identified an additional problem relative to the North <br />Thompson Creek Mine Application. This problem was brought to our attention <br />by representatives of Seavers Ranch and Development in a meeting held <br />August 11, 1981. She problem concerns the modification of an irrigation <br />ditch by Snowmass Coal Company to allow the construction of your loadout <br />conveyor system. The ditch is identified as Keiser Seivers Ditch and is <br />located approximately 200 feet below the Snowmass truck dump in Section <br />20. <br />Under Section 2.05.6(3)(a) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Division must insure that mining <br />activities are conducted to "ensure the protection of the rights of present <br />users to surface and ground water, which may be adversely affected by the <br />surface coal mining and reclamation activities" and to ensure the protection <br />of "the quantity of surface and ground water both within the proposed permit <br />and adjacent area from adverse effects of the proposed mining activities, <br />or where the protection of quantity cannot be ensured, to provide alternative <br />sources of water in accordance with 2.04.7(3) and 4.05.15." <br />In addition, the performance standards of Rule 4 under Section 4.05.15 re- <br />quires that "any person who conducts surface or underground mining activities <br />shall replace the water supply of any owner of a vested water right which <br />is proximately injured as a result of the mining activities in a manner <br />consistent with applicable State law." <br />The Division is concerned with the construction, maintenance, and reclamation <br />of this ditch, since it has been rr%dified by Snowmass Coal Company and the <br />ditch is a vital source of water to an adjacent ranch. Prior to permit <br />approval, Snowmass Coal Company will be required to supply the following <br />items as part of the pending application: <br />
