Cox <br />r <br />P.E: Written Findings <br />for Colorado Coal <br />Kline No. 1, File No. C-029-81 <br />This memo contains findings for the following sections: Geology, Ground <br />Water, Surface Water, Probable Hydrologic Consequences of Mining, and <br />Cumulative Hydrologic Impacts Assessment, Water Rights and Replacement, <br />and Backfill and Grading. The lack of surface water baseline is still a <br />serious problem with the permit. The surface Boater section contains <br />seven stipulations which essentiallq stipulate nn ade7uate surface water <br />monitoring nroyram. <br />A number of verbal agreements made to the Division by Perma Resources <br />need to be put down in writing and the mine plan amended to reflect these <br />agreements. The agreements which siginficantly effect the enclosed findings <br />are: 1) The 500 foot buffer zone on either side of Maitland Arroyo, <br />Gordon Arroyo, and the unnamed tributary to Maitland Arroyo; and 2) the <br />prohibition of mining within, or dewatering of old, flooded underground <br />coal mines until the State Engineer's water rights and the Colorado <br />Department of Health's water treatment concerns have been resolved. <br />Another concern, which has been noted and not subject to any agreement, <br />is the selective placement of coal processing wastes within the backfil2ed <br />areas. These agreements may significantly effect the mine plan for the <br />Colorado Coal Ffine No. 1. The following maps, drawing and texts changes <br />should be submitted prior to permit issuance: <br />1) The applicant should submit a map delineating the area where flooded <br />old mine workings exist. The applicant should also submit a series <br />of cross-sections which show the depth to the flooded mine workings. <br />2) The applicant should amend the mine plan map and any related maps <br />affected by the rtune plan amendment (i.e., topsoil handling map, <br />reclamation maps, vegetation maps, post-mining topography maps, etc.). <br />The "Mine Plan" map should delineate mining of coal seams above <br />the flooded mine workings and the 500 foot stream buffer zones <br />(e.g., time sequence of mining and mine limits). <br />
