-z- <br />3) The applicant should amend the text in the mine plan and reclamation <br />section of the permit to reflect the mining outside of the 500 foot <br />buffer zone and the mining only above the flooded mine workings. <br />4) The applicant should also amend the text to include a handling plan <br />for the coal processing wastes generated by the wash plant. This <br />amended text should state exactly where the applicant will place <br />these wastes to keep there outside of the _ground water table and out <br />of the root zones of plants. (A suggestion for the placement of coal <br />processing waste would be to place the waste at the top of the backfill <br />prior to covering the backfill with four feet of non-toxic cover.) <br />The lack of surface water quality and quantity data and the lack of a surface <br />and ground water plan still remain as vez'y sticky permittinn issues. The <br />stipulation of surface water baseline collection is a tenuous position for <br />the Division to take.
