DEPARTMENT OF NATURAL RESOURCESf' ~ v II I I II I II I II IIII III
D. Monte Pascoe, Executive D~recror
1VilNED LAND RECLAMATION
423 Centennial Building, 1313 Sherman Street
Denver, Colorado 80203 Tel. (303) 839-3567
David C. Shelton
Direcior

Mr. Darrel Nespe
Dorchester Coal Company
2795 Skyline Court
Grand Junction, Colorado 81501
Re: Frvita Mines No. 1 and No. 2 Application
Our File No. C-015-81
Dear Mr. Nespe:
This preliminary adequacy letter conveys concerns which have been identified
in the preliminary adequacy review of the above referenced application by
our staff. This.Ietter constitutes the sixty day notification of preliminary
findings as required in 2.04.4(1) of the Colorado Rules and'Regulations. The
preliminary nature of the enclosed comments must be stressed at this point.
Additional information may be required from Dorchester Coal Company as the
review continues.
The Fruita Mine No. I and 2 application is very well presented. The overall
organization and cross referencing is straightforward and clear. These
qualities will greatly facilitate the ensuing review process.
The Division's decision to approve, deny or modify the permit application or
to continue the review for another sixty days after the one hundred twenty
day review period expires depends largely upon how rapidly Dorchester
Coal Company responds to this letter. It is unlikely that the Division
will be able to have sufficient time to complete the review by the one
hundred twentieth day if your responses are received after May 25, 1981.
Please submit information in a form consistent with the application so
that pages can be replaced, etc. I recommend that once you have examined
our comments we have a meeting to discuss the issues.
If you have any questions or concerns, please contact either Fred Banta or
myself.
Sincerely,
Brian Munson
Reclamation Specialist
/k
April 9, 1981
