Drell: <br />The Division has decided that the pinyon-juniper type community that is <br />found within the proposed pit area of your mining operation is a minor <br />conununity because it is one of two communities in the area and only <br />comprises 4.6`/, of the total area to be disturbed. <br />Division policy does not require that quantitative sampling requirements <br />be met for minor vegetative communities. A qualitative description is <br />required and this had already been provided. <br />Therefore, it is agreed that a grassland community type shall be reestablished <br />in all disturbed areas at the mine and revegetation success standards for <br />the entire site will be set using grassland community information. <br />We will continue to work with you to establish acceptable species diversity <br />success criteria. I am enclosing 2 examples of how Chis issue has been <br />addressed by the Division and other companies in the past. <br />The Division has taken another look at the sections of the permit application <br />that address surface water and the hydrologic balance in general. At this <br />time the Division's position is that baseline quality and quantity data <br />must be collected for tl,e two majorarroyos at tfte earliest possible <br />opportunity but prior to any major disturbance occurring within 500 feet <br />of the arroyos. This data gaChering must continue throughout the life of <br />the mine. <br />
