Dept of Natural Resource REQUEST FOR FORMAL BOARD REVIEW C.R.S. §34-33-119 AND RULE 2.07.4 T0: MINED LAND RECLAMATION DIVISION 423 Centennial Building 1313 Sherman Street Denver, Colorado 80203 The Rockcastle Company, a corporation engaged in surface min- ing operations in Routt County, Colorado, respectfully requests that the Mined Land Reclamation Board provide formal review pursu- ant to Statute and Rule of the proposed Decision issued by the Mined Land Reclamation Division with respect to the following areas to which The Rockcastle Company, as operator and permittee, takes objection. In support of the request for review, The Rock- castle Company advises: 1. The Permittee/Applicant is The Rockcastle Company, P. 0. Box 773987, Steamboat Springs, Colorado 80477. 2. The Permit No. is 78-45. The Division's file reference is C-039-81. 4. The Proposed Decision and Findings of Compliance Document with respect to The Rockcastle Company's Grassy Gap #1 Mine has been issued by the Mined Land Reclamation Division. Publication has been effected and informal conferences have been had with the Division's representatives with respect to certain of the stipula- tions appended to the Proposed Decision, some of which are the subject of the applicant's mntinui-ng objection. The decision of the Division is to allow the issuance of the proposed permit; however, that issuance is subject to the applicant agreeing to thirteen separate stipulations, some of which the applicant feels are inappropriate and should be reviewed by the Board prior to finalization of the Division's Proposed Decision. 5. Issues: The applicant objects to the following stipula- tions set forth in the Proposed Decision for the reasons stated
