Stipulation #3 relates to an obligation on the applicant to test surface water sites and alluvial wells. The stipulation requests testing with a frequency which is impossible of performance because of the physical conditions which occur at the mine site dur- ing seasonal changes and appears to require testing beyond the period of expected operations. The appliant has proposed a more specific schedule for sample col- lection and testing, which takes into account the physical con- ditions on site and seasonal changes, as well as the expecta- tion that such collecting of samples and analyses thereof will provide meaningful data related to operations. 5.2 4. Stipulation #4 relates to placing of ground water wells and then sampling and chemical analy- ses of such samples. Ground water wells are already in place at locations approved by the Divis- ion. The applicant has proposed that the testing schedule and the analyses of samples proposed by the Division be modified to take into account physical conditions on site, including seasonal changes and the operational schedule of the applicant so that such information will provide meaningful data. 5.3 7.
